Terms of Service

1. Who we are

Testiy is a technology product of ARK Tech & Logistics, with registered address at 106 C, Karuvanchery, Parakkad, Thrissur, Kerala 680620, India. We provide independent document verification tooling, guided chat counsel, verification certificates, and a private Community network for paid members. Our primary website is www.testiy.com.

References to "you" mean the individual or legal entity using the Services. If you use the Services on behalf of an organisation (for example an agency or employer seat), you represent that you have authority to bind that organisation, and "you" includes that organisation.

2. Eligibility & accounts

• You must be at least 18 years old and legally capable of entering a binding contract.
• You must provide accurate registration information (including name, email, and date of birth where requested) and keep it updated.
• You are responsible for safeguarding login credentials and for all activity under your account. Notify us promptly of unauthorised use at support@testiy.com.
• One natural person should not maintain multiple accounts to evade limits, bans, or pricing. We may merge, suspend, or terminate duplicate or abusive accounts.
• At signup you must affirmatively accept these Terms, our Privacy Policy, and the data-collection notice covering India's Digital Personal Data Protection Act, 2023 (DPDP) and applicable EU/GDPR rules.

3. Description of Services

Depending on the product surface and plan you purchase or unlock, Services may include:

• Document verification audit: automated and/or human-assisted review of documents you upload (for example work permits, job offers, contracts, financial proofs, itineraries) against formatting, consistency, metadata, and fraud-signal checks.
• Risk Analysis Report & Verification Certificate: digital outputs summarising findings, with a verification code and public verify page where applicable.
• Free Chat / AI counsel: conversational guidance about pathways, document risks, and product navigation. Free Chat is not a substitute for a paid verification audit or legal advice.
• Testiy Community: a members-only network for eligible paid users (seekers, agencies, employers) including profiles, posts, vacancies, services listings, follows, and limited inquire messaging as configured.
• Account dashboard: applications tracking, reports access, and profile settings.

Feature availability, turnaround times, and entitlements vary by plan (for example Individual, Duo, Consultant, Firm, Express tiers). Plan details shown at checkout or on the pricing page control what you receive.

4. What we are not

• We are not an immigration law firm, licensed attorney, registered recruiting agent (unless separately stated for a specific product), travel agency, or embassy.
• We are not affiliated with VFS Global, BLS International, TLScontact, or any consulate or ministry.
• We do not guarantee visa approval, invitation letters, job placement, or employer sponsorship.
• Outputs are informational risk and formatting assessments based on materials you provide and publicly available standards; they are not legal opinions or government decisions.

5. Document authenticity & prohibited uses

You represent that you own or have lawful rights to upload every file you submit, and that you will not use Testiy to create, refine, test, or legitimise forged, stolen, altered, or otherwise illegal documents.

You must not use the Services to commit fraud against embassies, employers, banks, applicants, or any third party. Violation may result in immediate termination, report to authorities, and cooperation with lawful investigations.

Prohibited conduct also includes, without limitation:

• Scraping, reverse engineering, or attacking the platform; circumventing rate limits or paywalls.
• Uploading malware, or content that is defamatory, harassing, or unlawfully discriminatory.
• Impersonating another person or organisation in Community or chat.
• Using Community to solicit illegal recruitment, trafficking, or unlicensed overseas placement in violation of applicable law (including Indian emigration rules where relevant).
• Reselling Reports or Certificates as if issued by a government or as a guarantee of visa success.

6. Free Chat, paid plans & Community

6.1 Free Chat

Free Chat may be limited by message count, rate limits, or fair-use controls. We may change, throttle, or discontinue Free Chat without liability. Free Chat responses may be generated in whole or part by automated systems and can be incomplete or incorrect — verify important facts independently.

6.2 Paid audits & packs

Paid plans purchase digital audit capacity and related entitlements (human review windows, express handling, Duo seats, etc.) as described at purchase. Unused entitlements may expire according to the plan terms shown at checkout. Human review queues and SLA estimates are targets, not absolute guarantees (see Delivery Policy).

6.3 Community

Lifetime Community access for eligible paid members is a privilege tied to your account status and compliance with these Terms. Community features may include profiles, posts, comments, likes, follows, vacancies, service fee listings, applications, notifications, and inquire messaging between permitted roles.

• Agency and employer onboarding may require KYC / verification documents and manual approval. Pending applications do not guarantee acceptance.
• We may moderate, hide, or remove content and restrict messaging to reduce spam, fraud, and harassment.
• Seeker-to-seeker direct messaging may be restricted by product design; inquire flows may be limited to seeker → agency/employer as configured.
• Community is not a job guarantee marketplace. Listings are user-generated; perform your own due diligence.

7. Payments, taxes & pricing

• Prices are displayed before checkout and may include applicable GST or other taxes as shown.
• Payments are processed by third-party gateways (for example Razorpay). We do not store full card numbers.
• Prices may change prospectively; changes do not alter orders already successfully paid unless required by law.
• Refunds are governed exclusively by our Cancellation & Refund Policy. Digital services generally begin immediately and are non-cancellable once processing starts, subject to listed exceptions (duplicate charge, total non-delivery).
• Chargebacks initiated without contacting support first may lead to account suspension pending investigation.

8. Delivery of digital outputs

All deliverables are digital. Certificates and reports are provided via dashboard and/or email. Timelines depend on tier and queue load as described in the Digital Delivery Policy. You are responsible for providing a working email address and checking spam folders.

9. Intellectual property & licence

The Services — including software, models, prompts, UI, branding, report templates, and documentation — are owned by ARK Tech & Logistics or its licensors. Subject to these Terms and your payment of applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Services and to download your own Reports/Certificates for personal or internal business use related to your application.

You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Services except as allowed by mandatory law. Feedback you provide may be used by us without obligation to you.

10. User content (Community & uploads)

You retain ownership of documents and Community content you submit ("User Content"). You grant Testiy a worldwide, non-exclusive licence to host, process, transmit, display, and create derivative technical artefacts (for example OCR text, risk scores, thumbnails) solely as needed to operate the Services, improve safety, and comply with law.

You are solely responsible for User Content. We do not endorse Community posts, vacancies, or agency claims. We may remove content that violates these Terms or applicable law, with or without notice.

Public verification pages display limited certificate metadata you chose to generate; do not share verification links if you do not want that information visible to link holders.

11. Privacy & data protection

Our collection and use of personal data is described in the Privacy Policy, including DPDP (India) and GDPR/EU disclosures. Processing of uploaded identity and travel documents is sensitive; you consent to such processing as necessary to perform the Services you request. See also our retention and deletion practices in the Privacy Policy.

12. Third-party services

The Services may integrate payment processors, cloud hosting, email delivery, analytics, authentication (for example Google sign-in), and other vendors. Their terms and privacy notices apply to their processing. We are not responsible for third-party outages beyond our reasonable control, though we will work to restore Services.

13. Disclaimers

To the maximum extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, title, and non-infringement.

• We do not warrant uninterrupted or error-free operation, or that audits will detect every forgery or error.
• AI-assisted outputs may hallucinate or omit context; human review tiers reduce but do not eliminate risk.
• Embassy rules change; you must confirm current requirements with official sources.

14. Limitation of liability

To the maximum extent permitted by applicable law, ARK Tech & Logistics and its officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost travel costs, visa fees, hotel/flight forfeitures, lost data, or emotional distress, arising from your use of the Services or from any visa refusal or delay.

Our total aggregate liability arising out of or relating to these Terms or the Services shall not exceed the greater of (a) the amount you paid to Testiy for the specific paid service giving rise to the claim in the three (3) months before the claim, or (b) INR 5,000, except where liability cannot be limited under mandatory law (for example proven wilful misconduct where such carve-outs apply).

15. Indemnification

You agree to defend, indemnify, and hold harmless ARK Tech & Logistics and its personnel from and against claims, damages, losses, and expenses (including reasonable legal fees) arising out of: (a) your User Content; (b) your breach of these Terms; (c) your misuse of Reports/Certificates; (d) your submission of falsified materials to any authority or employer; or (e) disputes between you and other Community users.

16. Suspension & termination

You may stop using the Services at any time. We may suspend or terminate access immediately if we reasonably believe you violated these Terms, pose a security or fraud risk, fail payment, or if required by law.

Upon termination, your licence ends. Provisions that by nature should survive (including IP, disclaimers, liability limits, indemnity, and governing law) survive termination.

17. Export, sanctions & compliance

You may not use the Services if you are prohibited under applicable sanctions or export-control laws. You agree to comply with anti-corruption and anti-money-laundering laws applicable to your activities.

18. Force majeure

We are not liable for delays or failures caused by events beyond reasonable control, including natural disasters, war, terrorism, labour disputes, internet or cloud-provider outages, DDoS attacks, power failures, epidemics, or changes in law or embassy systems.

19. Changes to Terms

We may update these Terms. We will revise the "Last Updated" date and, for material changes, may provide additional notice (for example banner or email). Continued use after the effective date constitutes acceptance. If you do not agree, stop using the Services.

20. Governing law & disputes

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Courts at Thrissur, Kerala, India shall have exclusive jurisdiction, subject to any mandatory consumer protections that cannot be waived.

Before filing a claim, you agree to attempt good-faith resolution by emailing support@testiy.com with a description of the dispute and allowing thirty (30) days for response.

21. Miscellaneous

• Entire agreement: These Terms plus referenced policies are the entire agreement regarding the Services.
• Severability: If a provision is unenforceable, the remainder stays in effect.
• No waiver: Failure to enforce a provision is not a waiver.
• Assignment: You may not assign these Terms without our consent; we may assign to an affiliate or successor.
• Language: English controls if translations conflict.
• Notices: We may notify you via email, dashboard, or website posting.
