Germany work permit check: why a separate \"work permit\" from an agent is a warning sign

Indian workers don't get a separate German work permit: the right to work comes with the visa. Spot a fake \"work permit\" and check the employer first.

Short answer: Indian workers don't get a separate German work permit before the visa. German law requires every residence title, including the national visa, to state whether you may work. The Federal Employment Agency's approval is normally handled between authorities. So a stand-alone English "Germany Work Permit" PDF from an agent is a warning sign in itself.

In July 2026, police in Mohali registered a case after ₹10.5 lakh was paid for three Germany work visas backed by a job offer from the JW Marriott in Berlin. The hotel said no such application or offer existed (Times of India; Amar Ujala).

Does Germany issue a separate work permit to Indian workers?

Generally, no, Germany doesn't issue Indian workers a separate work permit. German law says every residence title, including the national visa, must state whether you may work and on what terms. Where the Federal Employment Agency (Bundesagentur für Arbeit, BA) has to approve a job, the embassy or foreigners' office normally gets that approval inside the visa procedure.

  • The law. Section 4a(3) of the Residence Act says every residence title must state whether employment is allowed, and the national visa is a residence title under Section 4(1) (§ 4a AufenthG; official English translation).
  • The BA's role. The BA's approval is obtained within the visa or residence procedure. The employer can speed this up by requesting a pre-approval (Federal Employment Agency).
  • A narrow exception. The BA issues an "Arbeitserlaubnis" instead of a visa in some cases of short-term quota employment (same BA page); this guide covers the visa route.

That is why there is no public "Germany work permit check" by passport number: in the normal route there is no stand-alone permit to check. You check the chain of documents instead.

How do Indians actually get permission to work in Germany?

The genuine route has four steps. A German employer makes you a job offer or contract. The employer may get a pre-approval from the Federal Employment Agency or a local foreigners' office. You then apply for a national (D) visa yourself, which carries the permission to work. After arrival, you get a residence permit in Germany.

  • A declaration that the job is real. The mission may ask you and your employer to declare that the job offer is genuine. False statements are criminal offences under the Residence Act (German missions in India).

Which German documents are real, and which are red flags?

Genuine German pre-visa documents exist, but they go to the employer, are in German, and name a real employer, job, salary and working hours. The Vorabzustimmung and the Erklärung zum Beschäftigungsverhältnis are real. An English "Germany Work Permit Certificate" issued before the visa, or an "approval letter from the German Embassy", is not a standard document for Indian workers.

A genuine pre-approval names a real employer with an address you can find in the Handelsregister, a specific job, a salary and working hours. If any of these differ from your contract, stop and ask the employer.

How do you check a German job offer from India, step by step?

Work through six checks: identify each document, find the employer in the official Handelsregister, contact the employer directly, compare every document, check your agent, and apply for the visa yourself through the Consular Services Portal. All of these use official German or Indian sources and cost nothing. If any check fails, stop paying.

1. Identify what you have

Offer letter, contract, "work permit", pre-approval, recognition notice or visa scan? Use the table above to see which ones are standard.

2. Check the employer

Search the company in the Handelsregister, Germany's official company register. Then find its official website and contact details yourself, not from the agent.

3. Contact the employer directly

Ask whether it made you an offer, for which job, and whether it requested a pre-approval. In the Mohali case, the hotel said it had made no such offer.

4. Compare the documents

Employer, job title, salary, working hours, start date and place of work must match across the offer, the contract and any pre-approval.

5. Check the agent

Your Indian recruiting agent should be registered on the Ministry of External Affairs' eMigrate portal. A placement agent in Germany may charge at most €2,000, only after a contract is signed, with no advances, and placement into an Ausbildung is free for the trainee. Whether that cap applies to agents in India is unclear, so ask what any fee is for. Be wary of "complete packages" that bundle a job, visa and certificates; German missions warn about fake job offers made to Indian citizens (fraud warning).

6. Apply for the visa yourself

Most employment visas are applied for online through the Consular Services Portal, which gives you the link to book your VFS appointment. The German missions say you don't need an agent and all forms are free (German missions in India).

What does it cost, and who is allowed to charge you?

German missions in India list a national visa fee of ₹8,300 (€75) for adults, plus a VFS service fee; appointments are free. German law for placement agents in Germany: at most €2,000 including VAT, only after an employment contract is signed, and no advances. Placement into an apprenticeship (Ausbildung) is always free for the trainee.

  • Visa fee. ₹8,300 / €75 for adults and ₹4,200 / €37.50 for minors, non-refundable, plus the VFS service fee (German missions in India).
  • Appointments. Only through VFS, at no cost. Agents can't influence appointments (fraud warning).
  • Placement agents in Germany. Section 296 of the Social Code III requires a written placement contract (§ 296(1)), allows a fee only once an employment contract results and bans advances (§ 296(2)), and caps the fee at €2,000 including VAT, or nothing for a minijob (§ 296(3)) (§ 296 SGB III). Agreements that break these rules are void (§ 297 SGB III).
  • Apprenticeships (Ausbildung). Only the employer may pay for placement into an apprenticeship, including nursing training; the trainee never pays (§ 296a SGB III).
  • Agents in India. Whether the €2,000 cap applies to agents in India is unclear, because the law is silent. Ask what any fee is for and get it in writing.
  • Fast-track procedure. €411 at the foreigners' office; visa and recognition fees are extra (§ 47(1) no. 15 AufenthV).
  • Package offers. "Language certificate without exam", "guaranteed visa" and "job plus visa" packages are red flags (see the cases below).

What extra checks apply to nursing and Ausbildung offers?

Nursing and Ausbildung (vocational training) offers need two extra checks. To work as a nurse, your Indian qualification must be recognised, and that recognition notice comes from a German state authority, not an agent. Language certificates come only from the exam provider. Any "certificate without exam" offer is a scam pattern.

  • Nursing. Recognition of foreign qualifications is explained on the official Anerkennung in Deutschland portal. A genuine recognition notice (Anerkennungsbescheid, or Defizitbescheid if you need further training) is issued by a German state authority.
  • Ausbildung. You need a training contract with a German company. Check that company in the Handelsregister and contact it directly, as you would any employer. Under German law, placement into an apprenticeship is always free for the trainee, including nursing trainees (§ 296a SGB III).
  • Recruiting nurses from India. India isn't on the list of states from which only the Federal Employment Agency may recruit for health and care jobs, so private recruitment of Indian nurses is allowed. The fee rules above still apply (§ 38 BeschV; annex).
  • Language certificates. In June 2026, a nurse in Bengaluru lost ₹3.67 lakh to a scam promising a German language certificate without an exam (Deccan Herald).

What are the warning signs of a fake German job offer?

The biggest warning sign is a stand-alone English "Germany Work Permit" issued before you have applied for a visa. Others are documents sent by the agent rather than the employer, an employer you can't contact or find in the Handelsregister, paid "appointments", and upfront fees. Any one of them is a reason to stop and check.

  • A stand-alone "Germany Work Permit" (certificate, card or letter) in English, issued before you've applied for a visa.
  • A document said to come from the German Embassy, a "Ministry of Labour" or the "Federal Employment Agency" that was sent to you by the agent rather than the employer, or that isn't in German.
  • You're told you can't contact the employer, or its contact details come only from the agent.
  • An employer that isn't in the Handelsregister, or a registered address that differs from the contract.
  • A "Vorabzustimmung" older than nine months, or one whose employer, job or salary differs from your contract.
  • The agent sells VFS appointments or "embassy approval". Appointments are free and only through VFS.
  • An unskilled job "with guaranteed visa" (warehouse, packing, cleaning) for lakhs of rupees.
  • "Language certificate without exam" or "recognition guaranteed" packages.
  • Upfront fees to a placement agent in Germany (German law: no advances; at most €2,000, only after a contract is signed), or any placement fee for an Ausbildung (always free for the trainee). For agents in India the German cap may not apply, so ask what the fee is for.
  • Requests for your passport number, date of birth and passport copy before any contact with the employer. The missions advise against sharing these with third parties.
